Terms of Use and General Service Conditions

INNOVATIONS IN HEALTH TECHNOLOGY LTDA, a private legal entity enrolled with the Brazilian CNPJ under No. 48.501.871/0001-15, headquartered at Rua Luiz Volkart, No. 282, Centro, in the city of Três Coroas/RS, ZIP 95.660-000 (hereinafter simply “Raquel Menopausa”), owner of the “Raquel Menopausa” trademark and of the domains <https://www.raquelmenopausa.com> and <https://www.raquelmenopausa.com.br> (hereinafter jointly referred to as the “Websites”), as well as of the application called Raquel Menopausa (the “App”), available on the App Store and Google Play, hereby establishes, through this instrument (“Terms of Use”), the general terms and conditions for accessing, using and operating its Websites and App (hereinafter jointly referred to as the “Platforms”). These Terms of Use are equally valid for all means of accessing and using the Platforms, including any electronic/digital device or feature.

By accessing, browsing, clicking and/or in any way using, consulting and/or consuming Raquel Menopausa's content, features, products and/or services, the individual and/or legal entity, through its legal representative (hereinafter simply “User”), whether duly registered or not, freely and expressly declares that they have read, understood and agreed to all the conditions established herein and to the Privacy Policy adopted by Raquel Menopausa, available in their most up-to-date version on the Platforms.

Raquel Menopausa recommends carefully reading the content of these Terms of Use and, should the User disagree with their content, we advise against using any of Raquel Menopausa's products and/or services.

1. Definitions

1 The glossary below sets out the meaning of the terms used throughout these Terms of Use:

User: A user of all of the App's basic features.

Beneficiary: A User who accesses the App and Raquel Menopausa's other services through a benefit granted by a corporate Raquel Menopausa client with which they have a relationship.

Advertiser: An individual or legal-entity User who displays its brand, products and/or services within the Raquel Menopausa environment by contracting through a financial investment or a grant duly formalized by contract, under the rules set out therein.

Content: All services, products, information, resources or materials made available or accessed on the Platforms by the User, including, but not limited to, text, sound (audio, music and the like), images (including photos, videos, graphics, icons and the like), programs, and combinations of Content such as audiovisuals, animations, interactive features and other available resources. This definition includes posts, videos, testimonials, dashboards, reports, promotional banners, communities, current and future, offered by Raquel Menopausa.

Diary: The individual profile resulting from the initial questionnaire, which establishes the characteristics and symptoms of Raquel Menopausa Users based on criteria related to the climacteric and Menopause period. It consists of a set of qualitative and quantitative indicators that measure the intensity of symptoms of that period and physical and chronological characteristics at the time of access, based on data provided by the User. This data, which varies in magnitude, format and scale, is useful for the User to track their symptomatic condition and progress through the climacteric and menopause period.

Registration or Account: The registration procedure by which a User account is created, through the provision of data and information, creating a private account within the Platforms' system. Based on the Registration, Users may acquire Raquel Menopausa products and services available on the Platforms.

Platforms: Websites owned by Raquel Menopausa, duly registered with the bodies and entities responsible for the classification and registration of domains, under the domains <https://www.raquelmenopausa.com> and <https://www.raquelmenopausa.com.br>; as well as the Raquel Menopausa App, available on the App Store and Google Play, with all the features and tools made available.

Posts: Items of content in text, audio, static image and/or video format; as well as combinations of these elements authored by Raquel Menopausa, by platform Users, or from external sources presented on the platform for Users' consumption.

Communities: Environments for exchanging information in text, sound, static image, video and/or combined format, subject to moderation and removal; organized in a way that allows interaction between Users and used for the purpose of providing contextualized information to Raquel Menopausa Users.

User: An expression that covers all categories of users provided for in these Terms of Use, including any and all types of visitors/browsers of the Platforms, whether or not registered with Raquel Menopausa.

Free User: A User in the free access category, which allows unlimited use of the App's features, and may be used by both registered Users and visitors. The platform's access and monetization categories are subject to change and redefinition over time, and are not definitively restricted to the specifications set out herein, and may be amended and recorded in the Terms of Use (this document).

2. Purpose

2.1 Raquel Menopausa's Purpose. Raquel Menopausa offers Platforms for interaction, content, information, biometric assessment, biometric data logging, and online reports, which the User has access to, aligned with Raquel Menopausa's purposes. Raquel Menopausa's purpose is to promote welcoming, information, interaction and knowledge through products and services that allow women going through the climacteric or menopause period, or Users indirectly related to these periods, to deal with it in a way that improves society's quality of life. The Platforms may be accessed by the User according to the features made available on the User Registration screens.

2.2 Purpose. The purpose of these Terms of Use is to govern the operation of the Platforms, establishing the rights, duties and obligations that govern the relationship between User, Advertisers and Raquel Menopausa. These Terms of Use do not exclude any specific provisions related to the features, resources, products and services made available to the User and to Advertisers through the Platforms, nor the content of any private instruments that may be entered into between User, Advertisers and Raquel Menopausa.

3. User Categories

3.1 Raquel Menopausa offers the following categories of access to and use of the Platforms:

Free User: The free access category, with unlimited features, which may be used by visitors who have registered on the Raquel Menopausa Platform. This category grants the User access to the diary questionnaire, posts, communities, biometric testing, and other features already present or to be developed and made available on the Raquel Menopausa Platform at no cost.

Advertiser: The User category, individual or legal entity, that will publish, subject to approval by the Raquel Platform and a previously established contract, advertisements in previously defined formats for products, services and/or information. Advertisements will follow the display rules (impressions, period, clicks, frequency, exclusivity) established in the contract.

Beneficiary: The User or Advertiser who uses Raquel Menopausa through a benefit granted by a legal entity with which they have a relationship. In these cases, Raquel Menopausa provides services to the legal entity that contracts it to make the Platforms available to the Beneficiary. Features will be made available to the Beneficiary according to what was contracted by the legal entity granting the benefit. This category may include the same features available to the User and Advertiser, as previously established by contract.

4. User Registration

4.1 Capacity. By accessing, using and, especially, registering on the Platforms, the User declares that they meet all the legal requirements ensuring they have sufficient legal capacity to enter into these Terms of Use and any other necessary instrument, and that they hold all the powers and authorizations to legally represent and bind, to the obligations assumed in these Terms of Use, the legal entity on whose behalf they may be acting. The following may not, directly or indirectly, access, use or register on the Platforms:

persons under 13 (thirteen) years of age;

persons under 18 (eighteen) years of age unaccompanied and unsupervised by a responsible party, with their guardians/legal representatives being fully and exclusively responsible for any acts performed within the Platforms;

Users blocked, suspended or banned from the Platforms.

4.2 Need for Registration. Registration is mandatory for all Users of the Platforms. To complete Registration, the User must carefully read and declare agreement with these Terms of Use, as well as the Privacy Policy, and provide all the information, data and documents requested during the Registration process. The information, data and documents requested may vary depending on whether the registrant is a User, Advertiser or Beneficiary. Specifications regarding data types and purposes can be found in Raquel Menopausa's Privacy Policy.

4.3 Truthfulness and completeness of the information provided. The User undertakes to provide truthful, accurate, up-to-date and complete information, data and documents during registration. The User assumes full responsibility for the truthfulness, accuracy, currency and completeness of the documents, data and information provided, and undertakes to hold Raquel Menopausa harmless and fully indemnify it for any type of damage or loss suffered in this regard. A lack of accurate, complete and up-to-date information may result, at Raquel Menopausa's sole and exclusive discretion, in the deletion of the User's account, as well as of any and all information linked to it, and of the User's access to the Platforms and Content. A lack of accurate information violates these Terms of Use and constitutes a serious breach. Accordingly, the legal entity assumes joint and several liability for all information, data and documents provided by its Beneficiaries.

4.4 Updating the Registration. The User undertakes to keep their Registration/Account permanently up to date, and is therefore obligated to change/edit their registration data and information whenever necessary.

4.5 Approval and maintenance of the Registration. Providing all the information and requested documents does not guarantee the User approval of their Registration, nor its continuation. Raquel Menopausa reserves the right to refuse, limit, block, suspend or cancel the User's access and/or Registration/Account, at any time, regardless of justification or prior notice, as this is a matter of Raquel Menopausa's sole discretion. In the event of cancellation, the User may be notified when attempting to access the system that their Account has been canceled for, for example, having breached the Terms of Use and/or the Privacy Policy, or a related instrument, with Raquel Menopausa retaining the right to do so with or without justification. Cancellation does not give rise to any right for the User, who automatically loses, including, access rights to acquired Content, generated Content, as well as any data and content linked to their Account, regardless of whether the granted access period had ended or not.

4.6 No guarantee of contracting. The User declares they are aware that approval of their Registration/Account does not guarantee access to all Content, products, services and features available on the Platforms, since, among other reasons, these may depend on separate contracting and/or specific approval procedures.

4.7 Access account. Once their registration is approved by Raquel Menopausa, the User will receive an access account with a login and password (“Keys”), which will allow them access to the Platforms, according to the access category and the scope of their contract with Raquel Menopausa. The access account Keys are unique, personal and non-transferable, and the User is prohibited from assigning or sharing them with unauthorized third parties.

4.8 Responsibility for access Keys. The User assumes full responsibility for the integrity and confidentiality of information related to their account's access Keys, which are for personal, non-transferable use, essentially with regard to protecting their password. In the event of loss or leak of a password, suspected unauthorized third-party access to their Account, or any indication of loss of their registration data or information, the User must contact Raquel Menopausa immediately and report the incident.

5. Payment

5.1 Payment methods. Payment for Advertisements sold by Raquel Menopausa, according to the respective categories, must be made directly through the Platforms' purchase screens. Enrollment takes place according to the usability format and features decided by the Advertiser and, in the case of the Beneficiary, according to the choice of the legal entity granting the benefit. Information and prices will always be available for consultation in the most up-to-date version of the Platforms. Enrollment in Content may occur in the following formats:

Directly on the website <www.raquelmenopausa.com> and/or <www.raquelmenopausa.com.br>: An acquisition category according to the format, period and frequency of advertisements available for viewing and configuration on Raquel Menopausa's ad management Platform. Investment and advertisement performance reports can also be accessed in that same environment.

Users who are not Advertisers are not charged any costs for using the platform.

5.2 Responsibility. The User declares they are aware that payment for Raquel Menopausa Advertisements, according to the categories available on the Platform, may be made through third-party stores or independent intermediaries, commercial Ad Management platforms, such that Raquel Menopausa therefore receives only percentages related to this sale, and has no type of interference or control over refunds and returns of payments already made, and any claims regarding payments must be directed to the third-party stores.

5.3 Changes. Raquel Menopausa reserves the right, at any time and at its sole discretion, to make changes to the fees and publication of advertisements in effect. The Advertiser will be notified in advance in the event of changes, and may choose to end their campaign if they disagree with the changes made, or keep it running until the scheduled or contracted period is complete. Discontinuation of the platform suspends the display of advertisements without any financial reparation to the advertiser and without any obligation to maintain the advertisements for the contracted periods.

6. General User Obligations

6.1 General Obligations. In addition to the other specific duties and obligations set out in these Terms of Use and in the other instruments that govern the relationship between User, Advertiser and Raquel Menopausa, the User agrees and warrants that they:

will observe and fully comply with all of Raquel Menopausa's rules, as well as use the Content and Platforms in a manner consistent with any and all applicable laws and regulations, always in accordance with ethics, morals, and the principles of good faith, taking particular account of customs and good practices;

will fully comply with the commercial terms assumed when contracting each service and/or product made available on the Platforms, as well as all of the partners'/third parties' own rules that they may become bound by through the Platforms;

will not post, copy, reproduce, publish and/or transmit, in whole or in part, any of the Content from the Platforms, or from Raquel Menopausa, even if temporary usage rights were acquired, without Raquel Menopausa's express consent, except for Content made available for that purpose, such as sharing features. Even with authorization, the User may not disclose them in an inaccurate, misleading or false manner, especially given that the Content is provided targeted to each User's profile;

will not defame, abuse, harass, stalk, threaten or violate the legal rights of other Users and third parties;

will not impersonate any person, User or entity that does not actually correspond to their identity;

will not post messages containing illegal, improper, profane, defamatory, obscene or indecent material, including any content that infringes third-party rights, such as patent, trademark, trade secret, copyright or other property rights of any kind, as well as content containing images of other people, especially minors, nudity content, or content that may in any case be considered abusive.

will not upload or send files containing viruses, corrupted files, or any other similar software or programs that may adversely affect the operation of another computer;

will not run contests, distribute chain messages, or run “pyramid” or marketing schemes;

will not promote the sale of products and/or services not directly related to menopause and the climacteric. Users undertake not to use the app for unauthorized commercial purposes, under penalty of account suspension or deletion, as assessed by the responsible team.

will value the safety and well-being of the community, using the app responsibly and with respect for other users. Sharing links, QR Codes or invitations to external groups (such as WhatsApp and Telegram) must be done cautiously and only when it positively contributes to exchanges between participants. We value having conversations, tips and experiences take place within the app, where we can ensure a welcoming and safe environment. Content with external links may be reviewed by the Raquel Menopausa team, especially where there are excessive posts, user reports, risk of scams, user solicitation, or unauthorized commercial promotion; should anything be identified that could compromise the integrity and safety of the community, the content may be removed and, if necessary, the user will be guided by the team.

will not violate any applicable rule, whether municipal, state, national or international;

will safeguard Raquel Menopausa's names, trademarks and reputation, and will not violate any third-party rights, particularly with regard to intellectual property.

6.2 Equipment and auxiliary services. The User will be responsible for obtaining and maintaining the equipment and auxiliary services necessary to connect to, access the Platforms or use the Content, including, without limitation, modems, hardware, network cards, routers, programs (including a compatible, suitable and duly updated operating system), accessories, and internet, long-distance, broadband and/or local telephone access services. The User will be solely responsible for ensuring that such equipment or auxiliary services are compatible with the Content and Platforms. The User must keep their programs, including the operating system and antivirus programs, duly updated, in order to prevent unauthorized persons from accessing Content exchanged between the User's device and Raquel Menopausa, or even capturing User information that may be considered sensitive.

6.3 Non-compliance. In the event of non-compliance, or suspected non-compliance, with any of the User's obligations and duties set out in these Terms of Use, Raquel Menopausa is exempt from any liability towards the User and/or third parties, and reserves the right to limit, block, suspend or ban the User from the Platform, at any time and at its sole discretion.

7. Operation of the Platforms

7.1 Instability. The Platforms are provided as-is, with Raquel Menopausa assuring the User that it will make efforts to keep them available for as long as possible. Although Raquel Menopausa has an interest in keeping the Content available for as long as possible, operating errors may occur, especially when deploying new features, technical maintenance, updates or improvements. Any errors in the operation of the Platforms will be corrected as promptly as possible, during periods designated for maintenance, at Raquel Menopausa's sole discretion. As the Platforms are hosted on third-party infrastructure, they may, on occasion, be unavailable due to unforeseen events. In such cases, the User may notify Raquel Menopausa so that it can take whatever steps are possible to restore the Platforms' availability.

7.2 Responsibility. Raquel Menopausa is not responsible for damages resulting from the unavailability or malfunction of the Platforms, since the User is aware that the Platforms may undergo periods of maintenance and/or unavailability.

8. Content

8.1 Raquel Menopausa does not warrant the Content or any information, express or implied, that the User may acquire, access, receive, consume, or any technique that the User may carry out on the Platforms, or based on them. By using the Platforms, the User releases Raquel Menopausa from any liability for its own conclusions and interpretations regarding the Content, as well as for any losses or damages, even moral or aesthetic ones, resulting from the use of any Content. It likewise releases Raquel Menopausa from any content, services or information external to the Platforms that the User may access as a result of sources that improperly transmitted, or even with authorization, such content through the Platforms.

8.2 The User expressly declares that they understand and agree that:

Raquel Menopausa provides the Content for the User's benefit and grants no warranty of any kind, whether express, explicit, implied or otherwise, with respect to the Content. Raquel Menopausa specifically disclaims any warranties of fitness for a particular purpose regarding any treatment, since it is a platform for sharing its own and third-party content and information;

use of the Platforms and Content is at the User's own risk. The User and/or Advertiser does not hold Raquel Menopausa liable for any damage resulting from their access to or use of (or loss of access to or loss of use of) the Platforms, including, without limitation, any damage whatsoever to their computers, media or data, even if remotely possible;

they have no right to the data created through, or generated by, their access to or use of the Platforms. Such data may be used by Raquel Menopausa for the purpose of generating scientific knowledge and improving the Platforms' products, as described in the Privacy Policy;

neither Raquel Menopausa, nor its respective employees, directors, agents, third-party content providers, designers, distributors, merchants, sponsors, licensees or the like (collectively, “Contributors”) warrant that use of the Platforms will be uninterrupted, absolutely secure, error-free, or will meet the User's needs and expectations;

Raquel Menopausa and the Contributors do not warrant the accuracy, integrity or completeness of the Content provided on the Platforms, or of any other services and/or products that may be offered;

any applicable error-correction measures will be taken in the best way possible according to Raquel Menopausa's capacity, as described in these Terms of Use;

Advertisement prices and Content availability are subject to change without prior notice. Raquel reserves the right to revoke, at any time and regardless of prior notice, offers made available to Users and Advertisers;

an offer made after the User's or Advertiser's acquisition of Content, with better conditions than those contracted, does not give rise to a right to a refund, equalization or any kind of indemnification, given that at the time the legal transaction was entered into, the offer was not available;

the Platforms and Content could not be provided without these limitations.

8.3 Notice on Questionable Content and Reporting Feature:

We strive to maintain a safe and welcoming environment on the Raquel Menopausa App. However, users should be aware that they may occasionally encounter material they consider questionable, inaccurate or inappropriate. Should this occur, we provide a reporting feature within the app, allowing users to report content that violates our guidelines. Our team will review all reports and take appropriate action to ensure the platform's quality and safety.

9. Limitation of Liability

9.1 No doctor-patient relationship. The User declares they are fully aware that Raquel Menopausa does not offer any type of medical or psychological treatment, expressly acknowledging that the other services provided amount to the mere publication of informational content, and that a recommendation may occasionally be made to the User to seek specialized professional services. Raquel Menopausa does not prepare or issue diagnoses or definitive guidance, nor does it indicate or recommend the use of any type of medication or medical or other technical procedure. The User acknowledges that the services offered by Raquel Menopausa may occasionally have informational effects, but do not constitute medical or psychological practice, and no clinical doctor-patient relationship is established with Users, ruling out any liability on Raquel Menopausa's part in this regard.

9.2 Reports and metrics. The User declares they are aware that any reports and metrics issued are merely informative, and are prepared strictly on the basis of information provided by Users, who assume sole responsibility for the accuracy of the data made available to Raquel Menopausa. Raquel Menopausa will therefore not be liable for any use the User makes of the information provided within this relationship.

9.3 Advertisements. Regarding advertisements, the Advertiser declares they are aware that Raquel Menopausa will publish the media elements previously defined under contract through its technology platforms and integrated third-party platforms. Raquel Menopausa is not responsible for guarantees of financial performance generated by advertisements, such as revenue and sales. Raquel Menopausa's responsibility is limited to the publication/display/placement of advertisements as defined in the previously established contracts.

9.4 No commitment to results. Raquel Menopausa makes no commitment to results or any kind of direct positive consequences regarding Users' health status, nor with regard to general health and well-being indicators in professional environments.

9.5 Losses and damages. The User acknowledges and agrees that Raquel Menopausa is not liable for losses and damages of any kind, direct or indirect, arising from the User's use of the Platforms and Content, and is fully exempt from liability with regard to, for example, decisions, conclusions and/or deliberations made by the User based on information made available by Raquel Menopausa, as well as for any act or omission by Users within the Platforms.

10. Intellectual Property

10.1 Raquel Menopausa Intellectual Property. Raquel Menopausa holds and retains ownership rights over the Platforms and Content, except where expressly indicated otherwise. The Platforms and Content are therefore protected by copyright, registered trademarks and other Raquel Menopausa property rights. Accordingly, the User declares they are aware that all Content displayed or performed on the Platforms (including, but not limited to, texts, graphics, charts, tables, applications, articles, news, photographs, images, illustrations, audio and videos) constitutes intellectual property, protected by copyright and/or trademark law, in accordance with Brazilian law and international conventions.

10.2 Storage. The User must respect all copyrights and restrictions contained in any Content accessed through the Platforms. The User must not store any Content from the Platforms, except where explicitly permitted (for example, text files to be downloaded or files that are part of the provided apps and content), and only for as long as they are granted. Downloading, copying or storing any part of the Content without Raquel Menopausa's express prior authorization, or that of any other copyright holder, is expressly prohibited.

10.3 Indemnification. The User acknowledges the difficulty of determining the exact amount of any damages resulting from misappropriation of Content, especially if exploited for commercial use on a website, app or any other digital or printed medium. Therefore, should the User copy without authorization or in any way misappropriate Content from Raquel Menopausa, even without intending to gain an advantage, Raquel Menopausa has the right to seek indemnification for material and moral damages, regardless of the Content used, provided, copied, misappropriated without express authorization, or even Content that was improperly accessed due to a failure to observe the security practices reasonably expected of a user of computer systems.

11. Confidentiality

11.1 Confidentiality. The User undertakes to keep confidential and under absolute secrecy, and not to exploit, share or otherwise use outside the scope of these Terms of Use, any type of data, materials, documents, information and technical works of Raquel Menopausa and of its clients, suppliers and partners that they may access through the Platforms, notably where these involve Users' health data, and such information may only be disclosed to third parties, in whole or in part, or used for purposes other than those covered by these Terms of Use, with prior express authorization.

11.2 Use of information. Except for information in the public domain or where expressly authorized, the User agrees that they may not copy, modify, publish, transmit, distribute, perform, display to third parties, sell, produce derivative works, exploit in any way, or even leave freely accessible, share or retain, any information contained on the Platforms; the User therefore has the right to use information from the Platforms only for their personal, non-commercial use.

12. Penalties

12.1 The User agrees to indemnify Raquel Menopausa for any losses or damages, including attorneys' fees, arising from their activities or use of the Content, broadly speaking, that violate these Terms of Use, or from claims made by third parties against the User. The User also agrees to indemnify and hold Raquel Menopausa harmless for any improper, wrongful or illegal use of their Account by third parties, even if they granted permission to use their Account, since an Account may only be used by the User to whom it is linked. Purchases resulting from improper use of an Account are the sole responsibility of the User to whom it is linked, and Raquel Menopausa is exempt from any liability regarding such improper use.

13. Privacy Policy

Use of the Platforms is subject to the User's agreement with the Privacy Policy. For further information, please see our Privacy Policy.

14. Termination and Refund

14.1 Cancellation by the User. The User and the Advertiser may, at any time, cancel their Accounts, Registration and access, subject to the following terms, according to the applicable enrollment category (see item 6 of these Terms of Use):

On the App Store and Google Play app stores: The User may cancel their account from within the App, and must always observe and refer to the cancellation procedures set out under those stores' respective rules.

Advertisers may cancel their advertisements through the website <www.raquelmenopausa.com.br> and/or <www.raquelmenopausa.com.br> or through third-party ad management tools integrated with Raquel Menopausa, with no refund of amounts previously invested.

14.2 Responsibility. Raquel Menopausa has no control over the cancellation of Platform accounts, content and Advertisements carried out through the App Store and Google Play app stores, under item 13 (a) above. Should the User or Advertiser have difficulties or problems with account cancellation requests, they must contact Raquel Menopausa Support at the contact email listed in item 15 of these Terms of Use.

14.3 Restitution. Raquel Menopausa will not, under any circumstances, return or refund amounts paid by the Advertiser, given that billing is carried out by third parties, such as ad management Platforms.

14.4 Termination. Once the contracted/purchased period ends, publication of the Advertiser's advertisements will cease automatically and immediately. The Advertiser may always renew their publication schedule by making a new purchase of the formats available on the Platforms.

14.5 Discontinuation. The User declares they are fully aware that Raquel Menopausa, at any time and at its sole discretion, may temporarily suspend or permanently discontinue the operation of the Platforms, without this giving rise to any right to indemnification of any kind, regardless of any loss or damage suffered. Should the Content, or the Platforms themselves, be discontinued, Raquel Menopausa will immediately cease publishing and displaying advertisements and content, without any financial reparation.

14.6 Non-compliance with rules. As already mentioned in these Terms of Use, Raquel Menopausa may also limit, block, suspend or ban the User and/or Advertiser for non-compliance with these Terms of Use and/or any other applicable instrument, as well as for violation of the law or any suspicion of unlawful or fraudulent practices.

14.7 Remaining duties. Even after the User's use of the Content and Platforms ends, the provisions of these Terms of Use will, by their nature, remain in effect, including, without limitation, the provisions on intellectual property, warranties, indemnification and limitation of liability.

15. Transfer of Account Ownership

15.1 All Raquel Menopausa Advertisement sales, since they are compiled specifically for the Advertiser's profile, are final and may not be reused for and/or by another Advertiser. This means that the Advertiser will not have the right to transfer their Account and/or advertising campaigns, and will be responsible for its use in accordance with the provisions of these Terms of Use.

16. Support Channels

16.1 Support Channels. The User has a support channel available on the Raquel Menopausa website through the “contact” link, or via the email <suporte@raquelmenopausa.com>. They may also contact Raquel Menopausa directly within the App, through the “Contact and Technical Support” option.

16.2 Reporting. In the event of a suspected violation of the provisions of these Terms of Use, or of any other instrument that governs the relationship between User, Advertiser and Raquel Menopausa, the User must report the incident via the email <suporte@raquelmenopausa.com>.

17. Final Provisions

17.1 Changes to these Terms of Use. Raquel Menopausa reserves the right to make changes to the Platforms and to its Terms of Use and Privacy Policy at any time. Where duly registered, the User and Advertiser will be notified of changes to the Terms of Use or Privacy Policy as soon as they access the Platforms. Regardless of notice, each time the User uses the Websites, they must access and reread the Terms of Use and other instruments applicable to the transactions and use of the Platforms in effect at the time of access. Any use of the Platforms or Content after the change will constitute express acceptance of such changes.

17.2 Digital signature. The User and Advertiser acknowledge contracting by electronic, digital and computer means as authentic, valid and fully effective, even if established through any type of electronic signature or certification outside the ICP-BRASIL standards, as set out in art. 10, §2, of Provisional Measure No. 2.200-2, art. 784, §4, of the Code of Civil Procedure, and art. 6 of Decree No. 10.278/2020. Accordingly, the User and Advertiser expressly agree, for all legal purposes and effects, that both (i) checking the “accept” boxes on any document (a “click and wrap” acceptance category), and (ii) using their Account's Keys (login and password), will constitute their full agreement within the Platform environment, both of which are valid and effective means of expressing their free will.

17.3 Tolerance. The omission, tolerance or delay by either party to these Terms of Use in exercising a right provided for herein shall not be construed as novation, waiver or forfeiture, nor shall the isolated or partial exercise of any right prevent the future or broader exercise of that right or of any other right at any time.

17.4 Invalid provision. Should any provision of these Terms of Use be judicially deemed invalid or recognized as unlawful, or should these Terms of Use be partially amended, the remainder shall remain in effect and continue to produce effects.

17.5 Applicable law. These Terms of Use shall be governed by the laws of the Federative Republic of Brazil.

17.6 Venue. The parties, by mutual agreement, elect the courts of the Comarca of Três Coroas/RS as the sole venue for resolving any doubts or disputes arising from this instrument, waiving any other venue, however privileged it may be.

18. Version

18.1 This is VERSION 1.2, dated [11/08/2025], of the RAQUEL MENOPAUSA PLATFORMS TERMS OF USE AND GENERAL SERVICE CONDITIONS and, at the time you accessed, clicked, used, consulted and viewed our Content, is the document governing your relationship with Raquel Menopausa. Any need to update these Terms of Use will be duly communicated or published on our Platforms. We reiterate that, should you disagree with these Terms of Use or any of their updates, you must immediately discontinue accessing, using, consulting and viewing our Content, as well as using the Platforms.
